Please read these Terms and Conditions carefully before using the Go Pottie mobile application or website. By downloading, installing, or using Go Pottie you agree to be bound by these terms. If you do not agree, do not use the app.
1. About the app
Go Pottie is a mobile application for recreational and commercial sea fishers to track fishing pot locations, log catch data, and share community reports. It is operated by the Go Pottie developer ("we", "us", "our"). Contact: support@gopottie.app.
2. Eligibility
You must be at least 13 years old (or 16 in the EU/UK) to create an account. By using the app you confirm that you meet this requirement. If you are under 18, you confirm that a parent or guardian has consented to these terms on your behalf.
3. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@gopottie.app if you believe your account has been compromised.
You may not create accounts for others without their permission, impersonate any person, or use the app for any unlawful purpose.
4. Acceptable use
You agree not to:
- Use the app in a way that infringes any applicable law or regulation.
- Submit false or misleading pot reports that could mislead other users.
- Attempt to reverse-engineer, decompile, or extract the source code of the app.
- Use automated tools to scrape, crawl, or bulk-download data from the app.
- Interfere with the app's servers, networks, or infrastructure.
- Harass, abuse, or harm other users.
5. User-generated content
When you add pot locations, catch logs, or community reports you grant us a non-exclusive, royalty-free, worldwide licence to store, display, and share that content within the app for the purpose of providing the service. You retain ownership of content you create.
You are solely responsible for the accuracy of the data you submit. We do not verify the accuracy of community pot reports and accept no liability for decisions made on the basis of in-app data.
6. Subscriptions and payments
Go Pottie offers optional paid subscriptions (Pro and Max) that unlock additional features. Subscriptions are billed through the Apple App Store or Google Play Store on a monthly or annual basis.
- Payment is charged to your App Store or Google Play account at confirmation of purchase.
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
- You can manage and cancel subscriptions in your device's subscription settings at any time.
- We do not offer refunds outside of what is provided by Apple or Google under their standard policies.
- Prices may change. We will notify you in advance of any price increase affecting your subscription.
Downgrading or cancelling a subscription takes effect at the end of the current billing period; you keep your paid features until then.
7. Free tier and advertising
The free tier of Go Pottie is supported by advertisements served by Google AdMob. By using the free tier you consent to the display of ads. Upgrading to Pro or Max removes ads entirely.
8. Intellectual property
The Go Pottie name, logo, app design, and all software are owned by or licensed to us. Nothing in these terms grants you any right to use our intellectual property other than as necessary to use the app for its intended purpose.
9. Safety disclaimer
Go Pottie is not a safety or navigation tool. Do not rely on it as a substitute for official nautical charts, tide tables, weather services, or maritime regulations. Always follow safe seamanship practices and comply with applicable fisheries laws. We accept no responsibility for any incident, loss, or injury that arises from reliance on in-app data while at sea.
10. Disclaimer of warranties
The app is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components.
11. Limitation of liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) the app, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising under these terms shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.
12. Termination
We may suspend or terminate your account at any time if we believe you have violated these terms or if continued access poses a risk to other users or the service. You may delete your account at any time via the app or by emailing support@gopottie.app.
13. Changes to these terms
We may update these terms from time to time. We will update the "Last updated" date and, for material changes, notify you via the app or by email. Continued use of the app after the effective date of any changes constitutes acceptance of the revised terms.
14. Governing law
These terms are governed by the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless local consumer protection laws require otherwise.
